Release and Waiver of Liability, Assumption of Risk, and Photo Release Agreement

California Skate Grand Terrace
22080 Commerce Way, Grand Terrace, CA
 
 
IMPORTANT:
 
All users must agree to the terms below before using the skating facility.
Minors (under 18) must have a parent or legal guardian complete and accept this waiver on their behalf.
 
 
1. Use of Premises
By entering the facility, I agree to use it only for its intended recreational purposes and will treat the property with care. I understand I am responsible for any damage I may cause.
 
 
2. Assumption of Risk

 I acknowledge that roller skating and related activities involve risk of injury, disability, or death. I understand that these activities may be unsupervised and that medical help is not guaranteed on-site. I voluntarily accept all risks associated with participation.
 
 
3. COVID-19 and Infectious Disease
 
I confirm that I (and any household members) have not experienced symptoms of COVID-19 or any other contagious disease in the past 14 days. I understand the facility cannot be held responsible for potential exposure.
 
 
4. Release from Liability
 
I release California Skate Grand Terrace, its owners, employees, and affiliates (the “Released Parties”) from any liability for injury, illness, death, or property damage resulting from my participation or presence at the facility, including COVID-19 exposure.
 
I waive my rights under California Civil Code Section 1542, which states:
 
“A general release does not extend to claims that the releasing party does not know or suspect to exist… that would have materially affected the settlement.”
 
 
5. Covenant Not to Sue
 
I agree not to pursue any legal claim against the Released Parties for incidents arising from my use of the facility.
 
 
6. Indemnification
 
I will defend and indemnify the Released Parties against any claims or damages caused by my actions on the premises.
 
 
7. Personal Property Responsibility
 
I understand that I am responsible for my own belongings, and that the facility is not liable for any lost, stolen, or damaged items.
 
 
8. No Representations by Owner
 
I accept the premises “as-is” and acknowledge that no guarantees have been made regarding safety or condition.
 
 
9. Photo/Video Release
 
I grant permission for photos or video of myself to be used by California Skate Grand Terrace for promotional purposes without compensation.
 
 
10. Governing Law and Venue
 
This waiver is governed by California law. Any disputes will be handled exclusively in Los Angeles County, CA.
 
 
11–14. Legal Clauses
 

• Survival: This waiver remains in effect after participation.

• Compliance: I will follow all applicable laws.

• Severability: If one part of this waiver is invalid, the rest remains effective.

• Entire Agreement: This is the full agreement. No changes are valid unless in writing and signed.

 
 
Acknowledgment
 
By submitting the form, I affirm that:
 

• I am 18 years or older, or the legal guardian of the minor listed.

• I have read and fully understand this waiver.

• I agree voluntarily and intend to be legally bound.
